With your registration or usage of our photos you accept our terms & conditions for this time and following contracts. Any changes or additions to a contract are valid only if we have confirmed them in written form. Jurisdiction and place of performance is Germany. If one of the provisions of this contract is or becomes invalid, the validity of the other provisions shall not be affected.

Picture material that is being made available always remains the property of the agency/the creator.
In case of unauthorized utilization, distortion or passing on of our picture material or unauthorized passing on of reprinting rights to third parties as well as the production of copies from digital data material or passing on of these to third parties and for the case that the customer has failed to delete the data after usage as it is foreseen in this contract, a minimum charge of five times the usual basic utilization fee is agreed.

Fees |
| 1. |
Each utilization of our picture material is subject to fee payment. Fees for licenced pictures are calculated according to the medium, format and volume of utilization. Each new utilization costs again. Fees for Royalty free pictures are depending on the size of the picture. This fee has to be payed just once.
The usage fee for all of our pictures has to be angreed before using a picture. All fees are net amounts without value-addeed tax.

It is possible to get exclusive rights. Please contact us for calculating a price.
Our invoices are payable within 30 days of the invoice date.

Rights and liability |
| 1. |
We just sell photos, if you are getting exclusive rights. Otherwise we just offer the rights to use our photos rights managed or royalty free. If you don't have a written permission, it is neccessary to delete rights managed photos after you used them. It is prohibited to sell, rent or give away our photos to third parties. |

An alienation or falsification of the copyright-protected information via drawing, photography, photo-composing or other changes using photo-mechanic or digital means is not allowed. Usages which are contradictory to the innate message of the picture, falsifications in picture and word as well as usages which might lead to a disparagement of illustrated persons are not permitted and make the user liable to pay damages. In such cases the user is obliged to keep animals-digital free from any claim from the injured persons. |

The user shall bear responsibility for the captioning. We shall not be liable if there is a violation of the rights of third parties. The User is obliged to observe the journalistic principles of the German Press Council (Press Code). |
| 4. |
In the case of damage, in particular damage including defects in hardware and software that arise during the use of the picture database or the transfer of the picture data, we are unable to accept liability.

Copyright and specimen copy |
| 1. | Based on § 13 UrhG (Copyright) we demand that the agency and originator are named explicitly, i.e. in such a way that no doubt may arise over the assignment of the respective picture. Every single utilization is subject to the regulations of the German copyright law. The omission of such a copyright notice shall constitute an entitlement to damages in the form of a surcharge of 100% of the corresponding licence fee.

A free specimen copy of each print publication must be send to us without our specifically requesting such. If pictures are used electronically as on-line media we shall be entitled to a digital "screen shot" documenting the URL or another form of documentation.
